This course is part of the Summer Program 2025 and taught by Prof. Ferrand (Université Jean Moulin Lyon).

This course includes a summary of the French judicial organization which was modified in 2020 and provides an overview of the recent trends in French law to favour amicable settlements through the use of ADR which is sometimes obligatory before filing a claim before court. It then discusses the French law of contracts. The French contract law was subject to a far-reaching reform in 2016. The aims of the reform as well as its contents are discussed. Important judgments given by the Court of cassation before and after the reform are also studied and discussed (especially reversal of case law). The course is held in French.
